Debate and Discussion over Disruption and Demonstration

 


Street Smart Democracy and Disruptive/Demonstrative Law Makers belonging to Opposition Parties are perils to the healthy freedom of speech and when such hooliganisms were staged in the most sacred temple of democracy called Rajya Sabha by our opposition members of parliament, then it becomes a Black Day for Democracy.

On August 11, 2021, the Rajya Sabha Monsoon Session witnessed an unprecedented scene putting the House of Elders in India’s Parliament to shame as some members of Rajya Sabha had committed sacrilege in the Temple of Democracy.  Now, the Rajya Sabha Chairman and Vice President M. Venkaiah Naidu had suspended 12 MPs, identified as those responsible for their unprecedented acts of misconduct leading to creating the unruly scenes of climbing the table, waving black cloth, throwing files, tearing down papers and pushing security staff and other members of the house in the august house in the month of August 2021 – 5 months before.

Twelve MPs were Syed Nasir Hussain, Phulo Devi Netam, Chhaya Verma, Ripun Bora, Akhilesh Prasad Singh and Rajmani Patel (all Congress), Priyanka Chaturvedi, Anil Desai (Shiv Sena), Dola Sen, Shanta Chetri (Trinamool Congress), Elamaran Kareem (CPI-M) and Binoy Vishwam (CPI). 12 MPs unruly and undemocratic acts are narrated hereunder to know the gravity of their violent behavious unworthy of their position they hold and elected:

v Dola Sen of Trinamool Congress had put a hanging loop made up of fabric/scarf around the neck on Shanta Chetri  and stormed up to the well of the house.

 v Dola Sen also obstructed the way of the leader of the house and parliamentary affairs minister and also pushed them.

v Phulo Devi Netam of Congress snatched, tore and threw papers in the house.

 v One lady marshal a security official from PSS/RSS was pulled and dragged by Phulo Devi Netam of Congress and Chhaya Verma of Congress and assaulted her in the well of the house.

 v Binoy Vishwam of CPI, Elamaran Kareem of CPI -M, Rajmani Patel of Congress and Anil Desai of Shiv Sena snatched papers and folders from the left and right sides of the chair.

 v Elamaran Kareem of CPI – M manhandled and severely choked the neck of one male marshal and dragged him in order to break the security cordon.

 v Akhilesh Prasad Singh of Congress recorded a video of the security staff and the table of the house.

 v Priyanka Chaturvedi of Shiv Sena and Syed Nasir Hussain of Congress tore up papers and threw them at the table of the house. Hussain also pushed Sanjay Raut of the Shiv Sena.

 v Ripun Bora of Congress climbed onto the LED TV stand installed on the left side of the chair.

The suspension notice said that the 12 MPs including maximum members of six from the Congress were punished under Rule 256 of Rules of Procedure and Conduct of Business in the Rajya Sabha. Congress Leader Mallikarjun Kharge protested strongly the action of the Chairman of the house stating that 12 MPs were suspended against the rules of the House.

But the opinions of Experts were:

1. The rules provide that the house is the master of its procedure and the procedure is regulated by its Speaker or Chairman. No appeal lies against the Speaker or Chairman of the house in the matter of procedure anywhere. That is the position.

2. The house can punish its members or outsiders for bringing disrepute to the legislature. The power of the house includes the power to suspend a member from attending the sitting for a day or for the remainder of the session.

In spite of the suspension of 12 MPs, the Chairman was ready to pardon them if they tender apology for their acts. But they have not shown remorse for their actions, but, to our dismay, they are protesting and saying that their suspensions are illegal and against their privileges as the MPs.

E-Touch feels that mere suspensions won’t work, but, the rules should be amended to make them to lose their MPs status so that the Sacredness of Temple of Democracy will be saved and protected so as to have only Debates and Discussions inside the houses of Parliament.
