Court Quashed Bribery Case against B.S.Yeddyurappa.

Allegation: Yeddurappa received a sum of Rs.10 crore from JSW Steels Ltd. as donations for Prena Trust run by his sons B Y Raghavendra and B Y Vijayendra and his son-in-law Sohan Kumar. He was indicted on the ground that his family members received a sales consideration of Rs.20 crore by selling a land to SouthWest Mining Company although the land value was barely Rs.2 crore.
Verdict: We (High Court Judges) are of the considered view that the petitioner was condemned, unheard and there is flagrant violation of the principle of natural justice/maxim audi alterm partem/fairness in administration action and statutory provisions.
There is no material placed on record to establish that the petitioner showed any official favour to the companies. The SLP challenging the grant of lease is still pending before the Supreme Court. The mining lease was granted in favour of the companies by the state in September 2007 when the petitioner was neither a mining minister nor a chief minister.
Approval of mining plan is vested with the Centre. Therefore, the petitioner showing any official favour to the companies during 2007 to 2010 is beyond any one’s comprehension.
Heavy Indictment on Lokayukta (Santosh Hegde) - Lokayukta, being a quasi judicial body, must be reasonable in its decision. When important rights of parties of far-reaching consequence are adjudicated in a summary fashion, without giving a personal hearing where proposals and counter-proposals are required to be examined, it would be directly destructive of judicial propriety and fair play.
Following remarks of Judges are unprecedented epochs making major hit to Santosh Hegde: Suspicion cannot be a ground to tarnish the image and reputation of a person who is holding a constitutional post.
Even during the investigation, Mr.Santosh Hegde in liaison with the present Governor of Karnataka had quite often aired and shared many of his views to the media and exonerating many others - like Dharam Singh and S.M. Krishna. If you view now his media clippings in the light of Honorable High Judges’ verdict, you can very well sense his one sole agenda of vendetta against the then Chief Minister - not befitting to hold that high office.
Verdict is clear vindicating Yeduyurappa and indicting Santosh Hegde.
Santosh Hegde should owe full moral responsibility for this fiasco and he should not be entrusted with any post hereafter in the Government.
And, B S Yeddyurappa should be restored as the Chief Minister of Karnataka without
any loss of time which will alone give real meaning to the holy sayings of “Satyameva Jayathe.”
